The Supreme Court of India is scheduled to hear on December 29 the Central Bureau of Investigation’s appeal challenging the grant of bail to former Uttar Pradesh legislator Kuldeep Singh Sengar in the Unnao rape case, a matter that has drawn nationwide attention and prolonged legal scrutiny.

The appeal has been filed by the Central Bureau of Investigation against a recent order of the Allahabad High Court that granted interim bail to Sengar on medical grounds.


Case Background

Sengar, a former BJP MLA from Unnao, is serving a life sentence after being convicted in 2019 for the rape of a minor in 2017. The case later expanded to include charges related to the victim’s family members, including a fatal car crash that killed the survivor’s aunt and left others injured.

The trial was transferred from Uttar Pradesh to Delhi on the Supreme Court’s directions, citing concerns over witness safety and fair proceedings. Sengar was subsequently convicted and sentenced by a Delhi court, with the verdict upheld on appeal.


CBI’s Objection to Bail

In its plea, the CBI has argued that the High Court erred in granting bail to a life convict in a case of extreme gravity. The agency contends that medical treatment can be provided under custody and that release on bail undermines the seriousness of the offence and public confidence in the justice system.
